Let me introduce myself. I am a child of Holocaust survivors. My mother survived Auschwitz and my father fought the Nazi war machine as a partisan during the Second World War. Ninety-eight percent of my extended family perished during the Holocaust.

Do not fall into this trap of meaninglessness and an unfulfilled life. You, the vice-chancellors of Australian Universities, have a chance right now to prove your life meaningful not only to yourselves, but also to the people of Australia by making sure that this war of annihilation against the Palestinian people ends and that the means for the continuation of this war end immediately.

If Attorney-General Mark Dreyfus’ refusal to drop the McBride prosecution wasn’t bad enough, his cabinet colleague Marles’ concealment of the Afghanistan oversight report is a new low for the Albanese government.

Not only does Marles’ repeated defiance of Senate orders based on non-existent “advice” constitute contempt of Parliament, his obfuscation to the Royal Commission shows a similarly contemptuous attitude towards the ultimate avenue of government transparency available under the Australian democratic model.

All this with the aim of perverting the outcome of a criminal trial that jailed the only person yet to be held accountable for Afghanistan war crimes – the whistleblower.

McBride’s lawyer, Mark Davis, announced an appeal against Mossop’s rulings “on the meaning of duty” moments after his client was marched out of court to jail. According to Davis, “This is an issue of national importance, indeed international importance, that a Western nation has such a narrow definition of duty.”

We can only speculate at this stage what role the Defence Minister’s handling of the Afghanistan war crimes oversight report might play in that appeal.

The battalion is also notorious for its alleged abuses of Palestinians and human rights violations in the West Bank, including an incident that led to the death of a 78-year-old Palestinian American man in 2022. These allegations landed the group, formally known as the Nahal Haredi, on a short list of IDF units that Secretary of State Antony Blinken intended to sanction last month. That move would have cut off the battalion’s supply of U.S. weapons and other military aid — until the Biden administration backed away from those plans under pressure from Israeli officials.

But the battalion has another reliable source of international support: a charitable nonprofit in the U.S.

A Misplaced Purity: Democracies and Crimes Against International Law – » The Australian Independent Media Network

Such arguments echo an old trope. The two administrations of George W. Bush spilled much ink in justifying the torture, enforced disappearance and renditions of terror suspects to third countries during its declared Global War on Terror. Lawyers in both the White House and Justice Department gave their professional blessing, adopting an expansive definition of executive power in defiance of international laws and protections. Such sacred documents as the Geneva Conventions could be defied when facing Islamist terrorism.

Lurking beneath such justifications is the snobbery of exceptionalism, the conceit of power. Civilised liberal democracies, when battling the forces of a named barbarism, are to be treated as special cases in the world of international humanitarian law. The ICC prosecutor begs to differ.

According to the main monitor of major food insecurity in the world, the Integrated Food Security Phase Classification, an estimated 1 million Gazans—half the population—are now in catastrophic food insecurity and famine conditions. This means approximately 6,000 deaths per month from starvation, half of them in children under the age of five. And none of these people are included in these statistics. Alex de Waal warned in March: “Gaza is already the most intense starvation catastrophe of recent decades… Famine is unfolding in Gaza today. We should not have to wait until we count the graves of children to speak its name.”

To the Palestinians she defended in military courts, she was known simply as Tamar. Often dressed in black, she was instantly recognizable by her short-cropped white hair, glasses, and her ever-ready smile that would often give way to a chuckle. Tamar Pelleg-Sryck was a lawyer, a fierce human rights defender, a principled opponent of the Israeli occupation of the West Bank and Gaza, and a wonderful human being whose drive, intellect, and youthfulness never strayed, even in old age. On March 11, Tamar passed away at the age of 97.

The Dead End of Liberal American Zionism

In 2014, we wrote an article titled “The Blind Alley of J Street and Liberal American Zionism.”

At the time, Benjamin Netanyahu was in his sixth continuous year as Israel’s prime minister, while President Barack Obama was well into his second term.

And J Street, an emerging organization of Jews aligned with the Democratic administration, had momentum as “the political home for pro-Israel, pro-peace Americans.”

From the outset, ever since its founding in 2007, J Street has implicitly offered itself as a liberal alternative to the hardline American Israel Public Affairs Committee (AIPAC), which was established more than four decades earlier.

An avowed purpose of J Street has been to seek a humane resolution of the Israeli-Palestinian conflict while maintaining fervent allegiance to Israel as “the Jewish state.”

The legal world was abuzz. The diplomatic channels of various countries raged and fizzed. It had been rumoured that Israel’s Prime Minister Benjamin Netanyahu, along with his cabinet colleagues, had been bracing themselves for a stinging intervention from the International Criminal Court, a body they give no credence or respect to.

Unfortunately, many a just cause sprouts from crime, and the protagonists can always claim to be on the right side of history when the world takes notice of a plight. Only at the conclusion of the peace accords can stock be taken, the egregiousness of it all accounted for. Along the way, the law looks increasingly shabby, suffering in sulky silence. These applications for arrest warrants are merely a modest measure to, pardon the pun, arrest that tendency. It is now up to the pre-trial chamber of the ICC to take the next step.

Obaid’s wife, who was displaced to a camp in Deir Al-Balah, told him that “watchtowers and cameras were deployed all along the [coastal] road, and … quadcopters and reconnaissance planes are monitoring the area and preventing citizens from returning to the north.” As Israel expands and cements this military architecture, Obaid observed, “it’s as if Gaza is entirely under their control.”

In essence, the genocide must be halted, Israel must be held accountable on a global scale, and it must bear the consequences of this crime. Subsequently, peace must be constructed by the collective international community, not solely by the U.S. or the West, allowing both Israel and Palestine to thrive together. A key step toward this is for Palestine to be admitted as a full member of the United Nations and one can only hope that the U.S. does not veto its current application.

Indeed, many Israelis and Jews around the world who oppose Zionism could be motivated to initiate reform once the charge of genocide is internationally and legally recognised. The journey towards reform and redemption will be protracted, but it will establish the foundation for lasting peace. Such metamorphoses have been observed in the past, in Japan and Germany. Their economies have since ascended to remarkable heights. However, these transformations were not immediate. They were preceded by international acknowledgment, condemnation and punishment for wartime atrocities. Only then were the steps towards restoration embarked upon.
