While efforts may have been made to mount a defense of assassinations such as that of Hamas’ Haniyeh, there is a simple truth: Lethal force is highly restricted, and assassination is never legal. The Conversation

He Fought the Law: Will the Law Win? | The Smirking Chimp

Netanyahu doesn’t believe in the rule of law. After all, he isn’t trying to arrest the leaders of Hamas, he is trying to kill them. Bringing Netanyahu to justice would be a repudiation of his “rule of the jungle” ethos. It would also signal to the sovereignistas that borders are no protection against prosecution for war crimes. His whole life, Netanyahu has fought the law. Let’s hope that, in the end, the law will win.

Ex-Prosecutor: Trump Enjoys Different System of Justice Because He’s Wealthy and White | The Smirking Chimp

Why isn’t Trump in Jail? Anyone else would be by now and ready to be paroled

Despite having been indicted four times in three separate jurisdictions, prosecutors are still having immense difficulty in actually holding former President Donald Trump accountable for his alleged crimes. One former federal prosecutor said that’s no accident based on his firsthand knowledge with the justice system.

Sixteen Young People in Montana Just Won a Historic Climate Lawsuit – Mother Jones

Two white youths raise their fists into the air in celebration. They stand next to a bright blue sign that partially reads "Montana Youth Making." In the background, others give high fives.

Would Dan allow a decision like this to happen in Australia? Or would kids trying to sue the State in Australia be decreed “Vexatious Litigants” and have them arrested for contempt?

A healthy climate is included in your constitutional rights, at least if you live in Montana. On Monday, District Court Judge Kathy Seeley sided with the 16 young plaintiffs who sued Montana three years ago, arguing that its pro–fossil fuels legislation violated their right to a safe environment. Seeley ruled in the case, Held v. Montana, that “plaintiffs have a fundamental constitutional right to a clean and healthful environment, which includes climate as part of the environmental life support system.”

“Harlan Crow is not, as Thomas claims, his ‘dearest friend’ so much as his corrupt benefactor,” said one critic. “Thomas is unfit to serve on any court, let alone our nation’s highest court.”

20 Striking Images of Protest Against Israeli Democracy Under Siege – Mother Jones

Since late January, hundreds of thousands of Israelis have been loudly protesting an impending judicial overhaul by the nation’s new right-wing government. The most controversial part of the proposal gives the Knesset, Israeli’s parliament, the power to overrule supreme court decisions with a simple majority vote, which means the nation’s top court would be unable to strike down objectionable laws. It would effectively, as one Israeli news report put it, “neuter” the court.

Opponents say the changes, if allowed, will “endanger the entire legal system” and cement the power grip of the ruling coalition led by Prime Minister Benjamin Netanyahu, who faces a corruption charge. (The Knesset already has approved another rule stating that a prime minister may only be removed from office for physical or mental unfitness.) Since the changes were proposed, Israelis have taken to the streets en masse to register their displeasure.

Indictments are coming: At long last, criminal justice will catch up with Donald Trump | Salon.com

After Cassidy Hutchinson, there’s not much doubt: Federal charges will happen — but Georgia may get there first

Trump is a veritable Houdini of white-collar crime, a master of lawlessness and impunity. Not only has he never been convicted of any crime, he has never even been charged with a felony..

As a litigator, Trump is in a league of his own. Since 1973 he has been involved in more than 4,000 lawsuits, and in some 60 percent of those as the suing plaintiff.

Until now, his litigation has almost always been about attracting attention and wearing down opponents. As the great litigator James D. Zirin, author of “Plaintiff in Chief: A Portrait of Donald Trump in 3,500 Lawsuits,” wrote of Trump: “What was important was to use the lawsuit to attract attention, to exert economic pressure, and to prove he was the kid on the block not to be messed with.”

The impending criminal charges to be filed against Donald Trump by the district attorney of Fulton County, Georgia, and the U.S. Department of Justice are both very different from the thousands of previous lawsuits in Trump’s career. Those  civil cases, both past and present, have always been about money. The soon-to-be criminal cases will be about Trump’s personal freedom — and whether he will be wearing an orange jumpsuit for the next several years.

Bad news for Trump now that the 'courts have wised up' to his game: legal analyst

it seems maybe the courts have wised up and maybe the courts are done letting nefarious litigants like Donald Trump weaponize the court delay to run out the clock. Because Donald Trump rarely has a meritorious lawsuit to bring. He is always trying to weaponize the delay and it looks like his luck may run out.”

Rittenhouse and Charlottesville Cases Put Fascism on Trial

The Kyle Rittenhouse murder trial and the civil suit against organizers of the “Unite the Right” rally in Charlottesville hold lessons about fighting fascism with the law.

Using tort law to bankrupt fascist organizations and individuals sits within a set of consequentialist anti-fascist practices: The court proceeding will not itself serve as a reckoning for fascist ideologies; the jury will not be passing judgment on the inherent evil of white supremacy. If successful, though, the plaintiffs will economically devastate several major white supremacist organizations.

In one-two punch to Donald Trump, Justice Deptartment approves release of taxes, memo

Donald Trump has long fought to keep his tax records from congressional investigators.

Washington: Former US president Donald Trump suffered twin setbacks on Friday, local time, when the Justice Department cleared the way to release his tax records and disclosed a memo showing he urged top officials last year to falsely claim his election defeat was “corrupt”. The department, reversing course from the stance it took when Trump was in office, paved the way for the Internal Revenue Service to hand over the Republican businessman-turned-politician’s tax records to congressional investigators – a move he has long fought.

Critical Rage Theory | The Smirking Chimp

So here’s the great irony: we’ve gone from a theory that considers racism inseparable from laws and institutions in American life to the actual enactment of rules and laws that forbid the teaching or consideration of racism as inseparable from American life. Put another way: if there ever was proof beyond a reasonable doubt that critical race theory is reality–that American institutions such as our legislatures and courts are sick to the core with racism–Trumpist Republicans are providing us that proof in spades. They are elevating critical race theory from theory to fact, and from controversy to necessity.

The Senate Acquitted Trump. His Legal Problems Are Just Starting. – Mother Jones

The Senate acquitted Donald Trump, again, on Saturday, but the former president’s legal worries are far from over. As a private citizen, Trump is no longer protected by the Justice Department’s policy against charging a sitting president with federal crimes. And Trump, his family and businesses, also have to worry about investigations in various local jurisdictions and at least one foreign country, lawsuits he used his presidency to dodge, and probes by congressional committees. Here are some highlights:

Those saying Cardinal Pell is not guilty need to understand how criminal law works

It implies that the jury did not comply with the Judge’s directions and the law. In all trials across this nation, juries are warned and directed they must only consider the evidence before the court.

Without the vast majority of us being present at that trial, we can be sure the learned Judge Kidd gave that direction.

critic of the verdict is Andrew Bolt, in an article in the Herald Sun (paywalled) and on Sky News, as reported upon here, where he stated:

“Pell could well be an innocent man who is being made to pay for the sins of his church and made to pay after an astonishing campaign of media vilification.”

Jury’s capacity to discharge their sworn duty to judge only on the evidence presented during trial. In their anonymity, they cannot respond; they are barred by law from responding to Andrew Bolt about their jury room deliberations.

No one else can usurp the jury’s role, only a Court of Appeal can do that.

The people who are going to be speaking in favor of this bill are all going to be paid by the industry … the people who are going to be voting on this bill are often also paid by the industry,” Lucas said.

Lucas was ordered by House Judiciary Committee members to desist from making “personal comments” about members. As Lucas persisted, her microphone was cut off. When lawmakers refused to let her finish speaking, she told them to “drag me off.” Security was called and in a video of the incident she can be seen being dragged from the floor.

I got dragged out of House chambers … Because I was listing out who has been donating to Delegates on the Judiciary Committee,” Lucas wrote on her blog.
