While Israel has the right to strike back at the Hamas organization in the wake of the latter’s hideous October 7 attack on Israel, it doesn’t have the right to do so in a way that recklessly endangers civilian lives. Beyond that issue, Israel is recognized by the United Nations at the occupying power of Gaza, and therefore has responsibilities under the 4th Geneva Convention of 1949 to preserve the lives and well-being of the occupied population. Finally, according to the Rome Statute that underpins the International Criminal Court, targeting a group such as “the Palestinians of Gaza” for death is a form of genocide, regardless of the number killed.

Mass Protests and False Hope: Israel’s Supreme Court is no Friend of the Palestinian People

Yes, Israel should be sanctioned, not because of Netanyahu’s attempt at co-opting the judiciary, but because the system of apartheid and regime of military occupation constitute complete disregard and utter violation of international law. Whether Israelis like it or not, international law is the only law that matters to an occupied and oppressed nation.

The problem with war crimes law and what needs to be done

Paul Taucher and Dr Dean Aszkielowicz argue that war crimes justice does not work the way commentators generally suggest it does. AFTER THE SECOND World War, the victorious Allies prosecuted German and Japanese civilian leaders and military personnel for war crimes. The decision to hold these trials was based partly on a belief that the decades prior to the war had seen a genuine awakening among nations that some rules should apply to the conduct of wars and that efforts must be made to avoid devastating conflicts.

Earlier in the show, when McNeil and Qunun are holed up in Qunun’s barricaded Bangkok airport hotel room – after Thai officials have cancelled her visa to force her home to what she claims is certain death from her family – she finds that her Australian Immigration profile account is strangely shut down.

Home Affairs Minister Peter Dutton, Immigration Minister David Coleman and Border Force have very serious allegations to answer in relation to this. Unsurprisingly, they did not respond to requests for answers.

But they need to.

Things have become so downright psychopathic in Australia’s border protection regime that we are now in extremis in breaking the basic rules of civilised democracy willy-nilly. All for some profoundly misconceived idea that our electorate will be ruled by fear, fright and division.
