The speed at which the UN and ICJ is operating favors Israel not the Unity of Nations,
I imagine that many of us grew up assuming that Australia was a good international citizen, setting an exemplary example for other countries. I have no doubt that a great number of us are now ashamed of our country’s response to the ICJ opinion, and wonder where we went wrong, and how we became beholden to the rogue state, Israel, and indeed, compromised our sovereignty to it and its Zionist supporters.
In the face of Israel’s intransigence the only way to secure Israel’s compliance with international law is the application of political and economic sanctions along the lines of those imposed upon South Africa which led to the deconstruction of that apartheid State.
Certainly Penny Wong is correct to say, as she did, that “We have been consistent in Israel having a right to self-defence” but as Israel has been found to be an occupier at all relevant times it is under particular international law duties to those under its occupation.
By continuing its military assault on Gaza, massacring civilians in Rafah, and intimidating opponents into submission, Israel is taking rogue action against the International Court of Justice’s Genocide Convention — and the US is enabling it.

In the absence of a response from the Australian government to the ICJ ruling, at least 81 groups representing civil society are observing with concern Australia’s failure to act to prevent genocide in Gaza, and have made the following submission to the International Court of Justice.

On 26 January, the World spoke to Israel and its supporters – on the issue of Gaza. The World spoke through the International Court of Justice (ICJ). There can be no doubt about that. A number of provisional orders were made. Israel, and its primary accomplice, the United States – hereinafter “the Empire” – did not like what the World said. The Empire has struck back. Let us consider what it has done.
Nevertheless, the Empire continues to strike back. Israel has made it absolutely clear that it does not consider itself restrained in any way by the ICJ’s rulings. The rest of the Empire seems to be content to accept Israel’s position.
In conclusion, we, Australia, must understand the ICJ’s orders and act accordingly. We must oppose the Empire. And we must publicise the message: “Palestine has the right to exist – and therefore the right to resist”.

I come from a family of Holocaust survivors, and the very fact that we are even talking about this, and that the accusation is not without grounds, is heartbreaking. My grandfather, the sociologist Zygmunt Bauman, wrote about the syndrome of victims who aspire to become victimizers, and why efforts must be made to prevent this. I fear that we have failed.
Within what time period is the Court’s decision expected?
There are no set rules, but in the Gambia v. Myanmar case, there was a decision within a month. It should be remembered that this [Gaza] case will continue after the hearing on the interim order. Israel will have to present evidence that will exonerate it from the claim that it is committing genocide, but in doing so could get into difficulties with the ICC. For example, it may explain that it bombed a certain place because it was pursuing a military objective, but it may thereby make admissions that create a basis for the claim that it used disproportionate force.
“How many more alarm bells have to ring and how many more civilians must unlawfully suffer or be killed before governments take action?” asked one human rights expert.
“If a majority of the world’s nations call for a cease-fire, yet fail to press for prosecution of Israel—what is to stop Israel from ethnically cleansing all Palestinians?” reads World Beyond War’s letter, which it urged supporters to send to governments that have been critical of Israel. “For that matter, what is to stop other nations from repeating a horror of this magnitude?”

In some ways, South Africa, with its historically thick layering of scar tissue regarding racial hatred, segregation, policing and administrative detention may be better suited than most in understanding the zealots prosecuting the war in Gaza. Far from proving a blood libel, the case may turn out to be something of a bloody revelation.
