When George Brandis, in one of his first actions after coming to power in 2013, sacked Disability Commissioner Graeme Innes and replaced him with the IPA’s Tim Wilson to be the Commissioner for bigots, we were given a frightening example of the blatant cronyism that has become a hallmark of the Abbott government.

Graeme Innes was Australia’s Disability Discrimination Commissioner from December 2005 to July 2014. During that time he has also served as Australia’s Human Rights Commissioner for three and a half years and as Race Discrimination Commissioner for two years.

Graeme is a Lawyer, Mediator and Company Director. He has been a Human Rights Practitioner for 30 years in NSW, WA and nationally.

As Commissioner, Graeme has led or contributed to the success of a number of initiatives. These have included the Same Sex: Same Entitlements inquiry, which resulted in removal of discrimination across federal law; the drafting of the United Nations Convention on the Rights of Persons with Disabilities, and its ratification by Australia.

Graeme was also crucial to the development of the National Disability Strategy and the Disability (Access to Premises – buildings) Standards 2010; as well as the establishment of Livable Housing Australia.

He has also been an active high profile advocate for the implementation of cinema captioning and audio descriptions and, as Human Rights Commissioner, undertook three annual inspections of Australia’s Immigration Detention facilities.

Graeme has been a Member of the NSW Administrative Decisions Tribunal; the NSW Consumer, Trader and Tenancy Tribunal; and the Social Security Appeals Tribunal. He has also been a Hearing Commissioner with the Human Rights and Equal Opportunity Commission.

He was Chair of the Disability Advisory Council of Australia, and the first Chair of Australia’s national blindness agency, Vision Australia.

In 1995 Graeme was made a Member of the Order of Australia (AM). In 2003, he was a finalist for Australian of the Year.

Tim Wilson, on the other hand, has no qualifications or experience to recommend him for the job.  He worked at the Institute of Public Affairs for seven years, serving as Director of Climate Change Policy and the Intellectual Property and Free Trade.  He was a vocal critic of the Human Rights Commission and during his time there the IPA called for the abolition of the commission.  Apparently his criticism of the HRC faded away when he found out how much he would be paid.

Tim Wilson now has a total salary of $389,000 plus vehicle and telephone expenses after the Remuneration Tribunal approved a travel allowance of $40,000 and a “reunion allowance’’ of $16,800 in addition to his base salary of $332,000 — back dated to February 17 when he took up the job.

This becomes even more obscene in light of the subsequent treatment of the disabled by the Abbott government.

Just under half of Australians with disabilities live at or below the poverty line. For the 30% who can work, poverty wages are the norm. The quality of life of Australians with disabilities compares very badly with other developed countries; in fact, it ranks as one of the worst in the OECD.

Some employees with disabilities are paid as little as 9% of the minimum wage – or 99 cents/hour, $8/day, $40/week – including some who work for government-supported Australian disability enterprises.

Over the last five years, some 10,000 employees with intellectual disabilities have sought to be paid more by pursuing a class action lawsuit. According to the federal and high courts, these employees have been illegally underpaid in breach of the Disability Discrimination Act for more than a decade. They are entitled to be compensated by the federal government. Instead, the government has done everything it can to block that effort.

In November, the federal government brought a bill before the Senate, designed to thwart the employees’ class action to recover their back pay. It was unprecedented; under the proposed law employees could accept half of their back pay in exchange for giving up their right to recover the other half. If they didn’t accept the offer, the government made it clear that it would continue to resist and delay the back pay claim in the courts for years.

The government lied to the crossbenchers in the Senate, claiming the employees would only recover half of their back pay in court after deductions for legal fees (false: it’s a pro bono case) and income tax (false: mostly the employees come under the income tax threshold). Jacqui Lambie, then still a PUP senator, parted ways with her colleagues and together with John Madigan and Nick Xenophon voted against the bill, which was defeated by one vote.

Within hours of the vote, Mitch Fifield resumed his lobbying of the crossbench senators, advising them that he would reintroduce the government bill in February 2015.

A few days before Christmas, the federal government cut funding to disability advocacy groups hoping that no one would notice. It did so shortly after reneging on its commitment to reform multinational corporate tax avoidance, a multi-billion dollar industry.

Groups which lost funding include the Australian Federation of Disability Organisations, Autism Aspergers Advocacy Australia, Blind Citizens Australia, Brain Injury Australia, Deaf Australia, Deafness Forum of Australia, Down Syndrome Australia, the National Council on Intellectual Disability, Physical Disability Australia and Short Statured People of Australia.

All up, these funding cuts are said to have affected around 140 groups who deal with about 200,000 individuals.

The cuts also hit groups working with homeless people, including National Shelter, Homelessness Australia and the Community Housing Federation Australia.

This, too, will exacerbate existing problems. According to the most recent data, an estimated 105,000 Australians are homeless while some 254,000 used homeless services in the last year.

From the beginning of this year, those applying for the disability pension will have to be assessed by a government-contracted doctor instead of their own GP.  Regular doctors will no longer be allowed to approve new DSP applications.

If the government doctor finds they’re not completely unable to work they could be put on the dole instead – which is about $160 a week less.

Instead of fixing a legitimate problem, ACOSS chief executive Cassandra Goldie says the end result will be a modest budget saving at the expense of greater poverty among those with disabilities who are already doing their best to find work in a “really tough” and discriminatory job market.

“We need a proper job strategy to open up job opportunities to reduce discrimination against people with disability and we would like to see the Commonwealth lead that charge,” Ms Goldie says.

Eligibility for the DSP had already been tightened under the previous Labor government, including tougher impairment tables and job search requirements.  Over the past decade the proportion of working age people receiving the DSP had remained relatively constant.

Last financial year, the Department of Human Services investigated 411 people for dishonestly claiming DSP, which clawed back $9.5 million.

However social security fraud represents about 0.02 per cent of payments.

Meanwhile, Kevin Andrew’s $20 million marriage counselling voucher scheme is to be scrapped because, of the 100,000 vouchers on offer, only a few thousand were taken up.

The appointment of “tough guy” Scott Morrison to the Social Services portfolio does not auger well for the vulnerable in our society.  Dubbing himself the “Minister for Economic Participation” the man who ‘stopped the boats’ declared he will now ‘stop the bludgers’.

As they ramp up the attack on the most vulnerable members of our society it is incumbent on all decent Australians to raise their voice in protest and help defend the rights of those who are unable to defend themselves.

The LNP’s new talent – How to disable people with a disability.

The LNP has effectively taken away the right of choice for people with a disability.  All Australians expect a fair go, a right to choose. However, this is now no longer the case if you have a disability. Someone will make this choice for you. For those with a disability who do not need an advocate; who can make their own decisions.  For those who need an advocate, this is taking away the right to choose, through denying the choices that the advocate can make on their behalf.  This is a blatantly disabling people with a disability, rather than enabling them.

This also strikes me as so raw and so insensitive not even a week after the passing of Stella Young. Stella Young, if anything, taught us that we should treat all people with disabilities as human beings. Taking away someone’s right to choose does not treat a person as a full human being. Kevin Andrews (as all neo-liberals do) is purely focused on money and not the welfare of the person, nor is he focused on client outcomes for a person seeking the disability pension.  Scott Morrison inheriting this portfolio, will contribute a ‘show no mercy’ approach to this situation.

In plain Australian English: The LNP does not give a stuff about people with a disability and how they should be treated.

One of the most concerning risks is that if the correct outcome for a person with a disability is not achieved, this will result in that person being moved to Newstart.  This person will then receive less money and will further exclude a person with a disability from accessing social inclusion activities, transport and even better choice of housing to name a few. Once again, the underlying message of the Government for welfare recipients is “they are liars and cheats and we must stop them.”

Through this agenda of stigmatization and segregation of welfare recipients, the LNP Government aims to use this stigma and marginalization, so major cuts to welfare and even full closure of some services will result in little resistance from voters. Everything about the LNP is underpinned by cuts, cuts and more cuts, as demonstrated even more today with cuts to housing advocacy and homeless programs, programs for the blind, deaf and acquired brain injury also losing critical funding.

Lisa Gunder’s article, Immoral and un-Australian: the discursive exclusion of welfare recipients, discusses the narrative / agenda set by political leaders since Howard.  The focus on the welfare agenda in the Howard era, when Abbott was Minister for Employment; set to recontextualise ‘have a go’ and ‘the protestant work ethic’ (as part of our national identity) within the welfare discourse.  In an analysis of Australian identity, the ‘Australian way of life’ features strong connections with hard work the middle class and a protestant work ethic.  From Howard to Abbott, they have used this ‘accepted view of our way of life’ strongly within speeches and narratives about welfare; to change how Australians see those who are truly disadvantaged.

The other most prominent issue that Gunder raises, is that in Howard and Abbott’s speeches, they highlight the success of the ‘in-group’ (non-welfare recipients) and mitigate the achievements of the out-group (welfare recipients).  In simple terms, they purposely avoid highlighting achievements of welfare recipients and focus on the negative.  This sets in place an agenda for stigmatization.

It is through this narrative, that has been used and built on since the Howard years, which sets the tone for stigmatization and paves the way for further cuts and punitive measures for welfare recipients.   If you reflect on the timeline, the progression of this negative narrative has extended from the unemployed, to the single parent, aged pensioners and veterans and now the Government believes its narrative has been accepted sufficiently by the ‘in-group’, that harsh and punitive measures for those on a disability will be accepted by the ‘in-group’ or mainstream Australia. In simple terms, the Abbott Government sees punishing people with a disability as a ‘vote winner.’  As Australians, we should strongly see this as a failure to our national identity.

It is simply not good enough for the ALP and Greens and any other party who opposes these measures and this narrative to simply say ‘it is not OK.’  A narrative has been built since Howard’s arrival at the podium in 1996; that has gradually been listened to and accepted by Australians that “it is fine to punish the ‘out-group (aka welfare recipients).’”   

As ‘punitive measures and harsh treatment’ are now the norm within welfare; the ALP and Greens need to create a very strong narrative and create a new discourse which places welfare recipients at the heart of the “A Fair Go” and speak loudly and strongly of not only achievements, but of compassion and humanity and how and why we should unequivocally provide assistance for those in need’.

It is essential for the progress of Australia to remain silent on any narrative punishing those on welfare and the disadvantaged and to reject and refuse to create a welfare out-group through stigmatization.  

We must move forward and change the narrative completely to build up the strength of our people, through true mateship, kindness and a fair go.   Only then, will we all have freedom of ability, freedom of choice, true inclusiveness and a greater participation in work and society by all.

In October, Labor voted to pass nearly $3 billion in budget savings with revised welfare legislation which will see Family payments cut and young people on a disability support pension will have their cases reviewed.

The laws will:

  • reduce the primary income earner limit for Family Tax Benefit B from $150,000 to $100,000
  • limit the FTB – A large family payment to those with four or more children
  • review the cases of people under 35 who are receiving a disability support pension
  • include untaxed super income in eligibility assessments for the Seniors Health Card
  • remove scholarships for students moving between major cities

The most substantial cuts will involve those families who lose entitlement to FTB Part B, worth just over $3000 per year, when their youngest child turns six and is at school, although transitional arrangements will apply until July 2017. Low income lone parents will instead get a payment of $750 dollars a year per child aged 6 to 12 years.

About $10 billion in budget measures, including increasing the pension age, reducing the rate of increases to pensions and freezing family payments, remain blocked.  In a bid to woo the crossbenchers, the Government has “repackaged” those cuts and changes to a new series of bills.

The Government proposes to freeze all income-test thresholds for most benefits for three years, and FTB payment rates for two. Freezing payment rates is regressive, since lower-income families bear proportionally higher cuts.

Lone parents earning around two-thirds of the average wage lose between 5.7 to 7.1 per cent of their disposable income. A single-income couple with two school-age children and average earnings loses nearly $90 per week or 6 per cent of their disposable income.

Compare this to the $29 or less than 1 per cent of disposable income paid through the Deficit Levy by an individual on three times the average wage – close to $250,000 by 2017–18. High-income couples could together bring in up to $360,000 per year and not contribute an extra cent.

There will be no transition for unemployed people under 25, who will receive Youth Allowance rather than Newstart. People under 30 will be required to wait for up to six months before getting unemployment benefits and then Work for the Dole.

An unemployed 23-year-old loses $50 per week or 18 per cent of their disposable income. An unemployed lone parent with one 8-year-old child loses $60 per week or 12 per cent.

Senator Abetz backed down from his ridiculous idea of making unemployed people apply for 40 jobs a month which would have led to 30 million job applications a month when there’s not even a couple of hundred thousand jobs on offer.

The Government has also launched a tender process for a new $5.1 billion employment services plan and work for the dole scheme to operate for five years from July 1 next year.  One wonders which private companies will benefit from this $5 billion cash splash and whether the money would not be better spent creating jobs rather than providing slave labour for the private sector who will receive generous payments to administer the scheme.

I also wonder has this government done any modelling on increasing the pension age to 70.  When they increased the age for females from 60 to 65 in 1995 , women with disabilities in this age group increasingly claimed the DSP. The proportion rose from close to zero to about 13 per cent by 2013.  But as the number of women receiving the DSP went up, the number receiving the age pension went down by much more.

In 1995, only about 650 women aged sixty to sixty-four received the DSP and 211,000 received the age pension. By 2012, 86,000 female DSP recipients were in that age group, but only 28,000 age pensioners. So the total number receiving one or other of these pensions has nearly halved, and now the majority receive the DSP.

Increasing the pension age to 70 will just force more people onto the DSP and increase the medical and administrative costs to receive their payment.  So much for cutting red tape.

I sincerely hope Labor have the number crunchers working out exactly how much people are worse off under this government’s policies.  Add in the delay to the increase in the superannuation guarantee, higher fees for university students, cuts to health and education, increased fuel excise, scrapping the increase of the tax free threshold, and every single person is worse off though inversely proportional to their income and wealth.

The Australian Council of Social Service released a new report revealing that poverty is growing in Australia with an estimated 2.5 million people or 13.9% of all people living below the internationally accepted poverty line.

The report provides the most up to date picture of poverty in the nation drawing on new data released by the Australian Bureau of Statistics Income and Expenditure surveys for 2011-12 and previous years. It finds that 603,000 or 17.7% of all children were living in poverty in Australia.

The poverty line for a single adult is $400 per week yet the maximum rate of payment for a single person on Newstart – when Rent Assistance and other supplementary payments is added – is only $303 per week. This is $97 per week below the 50% of median income poverty line.

It also emphasises the danger posed by Budget proposals to reduce the indexation of pension payments to the Consumer Price Index only, which is likely to result in higher poverty rates over time than would be the case if payments were indexed to wages and therefore community living standards.

Most at risk groups

  • Women – significantly more likely to experience poverty than men (14.7% compared to 13%);
  • Children and older people – face higher risks of poverty compared to other age groups (17.7% and 14.8% respectively);
  • Sole parents – at high risk with 33% in poverty in 2012 and 36.8% of all children in poverty were in sole parent households;
  • Born overseas – Poverty is higher amongst adults born in countries where the main language is not English (18.8%) than amongst those born overseas in an English speaking country (11.4%), or in Australia (11.6%);
  • Aboriginal and Torres Strait Islander people – ABS data does not include information to accurately measure this poverty rate, however 2011 HILDA data found 19.3% of Aboriginal and Torres Strait Islander people living in poverty, compared to 12.4% of the total Australian population;
  • People with a disability – latest available data does not allow this poverty rate to be calculated, however our previous report found 27.4% of people with a disability were living in poverty in 2009-2010 compared to 12.8% for the total population.

Abbott’s strategy to help these people is “we removed the carbon tax”.  Come on Labor, let’s compare that to all the other things they have “removed”.

Morrison doesn’t see helping these people as his responsibility.  He views them as his targets, the challenge he must face and subdue.

In the May budget they cut $44 million from the capital works budget for the National Partnership on Homelessness.

Three days before Christmas they axed funding to Community Housing Federation Australia, National Shelter, Homelessness Australia, disability groups and financial counselling services.

In the next budget, Scott Morrison is going to do something about making childcare more affordable.  This will be a welcome move if it isn’t just about making politicians able to claim for their nannies.

povertyHe will also be trying to sell Tony’s signature Paid Parental Leave Scheme or some sort of renegotiated version of it.  If it is means tested, completely unavailable to those over a certain income, then it may be worthwhile though it basically defeats Tony’s stated purpose of encouraging “women of calibre” to breed.  It’s interesting that this “workplace entitlement” is being promoted by the Minister for Social Security who wants the government to pay for maternity leave rather than the employer.  I guess Tony is desperate to have an answer other than carbon tax about what he has done for women but let’s not let it blind us to the needs of our most disadvantaged citizens.

As this government silences advocates for the homeless, the disabled, the young and the needy, our Indigenous and refugee communities, we, the public, must raise our voices to help protect our most vulnerable and to tell the government which direction we want this country to go.
